The New York Daily News is reporting that former Penn State assistant coach Mike McQueary plans to sue the university.
McQueary who is a former quarterback for the Nittany Lions will now be remembered for being the graduate assistant who walked in on Jerry Sandusky in the shower with a young boy in 2001.
McQueary filed papers in Centre County Common Pleas Court notifying the court that he plans to proceed with a whistle-blower lawsuit. It essential classifies McQueary as a person who tells the public or someone in authority about alleged dishonest or illegal activities (misconduct) occurring in a government department, a public or private organization, or a company or the Government .
University spokesman David La Torre indicated McQueary has not been employed by the school since June 30.
“He is no longer employed by the university,” La Torre told the Daily News Tuesday in an email. La Torre said Penn State would not comment on the Post-Gazette report. McQueary’s attorney, Elliot Strokoff, did not return a call from The News. Slade McLaughlin, a Philadelphia-area attorney who represents one of Sandusky’s victims, told The News he was not surprised that McQueary plans to take legal action.
“I haven’t seen the documents, but my guess is that (McQueary) will say his reputation was sullied, that he was ruined by what happened,” McLaughlin said. “A whistle-blower is similar to a ‘qui tam’ suit — McQueary could contend he came forth and was retaliated against, with the university taking away his position. Whether or not he has a good suit, it depends on the facts assembled.”
McQueary has not disclosed how much he will seek in damages.
